We wish to inform you about the personal data we process about you and for what purposes. Personal data includes all information relating to an identified or identifiable natural person, whom the law refers to as the “data subject”.

Contact

You have the option to contact us via the email address provided in our legal notice. This contact is made exclusively through the email program you use. We process the personal data you provide us during this contact for the purpose you indicated related to the contact.

 

Use of Google Analytics

If you have consented to it when visiting our website, we use Google Analytics, a web analysis service provided by Google Inc. (“Google”), for the statistical evaluation of our visitors’ usage. Google Analytics uses “cookies”, which are text files placed on your computer, to help analyze how users use the site. The information generated by the cookie about your use of the website will generally be transmitted to and stored by Google on servers in the United States. In case IP anonymization is activated on this website, Google will truncate your IP address within Member States of the European Union or other parties to the Agreement on the European Economic Area. Only in exceptional cases is the full IP address sent to a Google server in the US and truncated there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity, and to provide other services related to website activity and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics will not be merged with other data held by Google. Legal Bases for the Processing Mentioned Above

Art. 6 para. 1 sentence 1 letter a) GDPR for data processing based on your consent.

Art. 6 para. 1 sentence 1 letter b) GDPR for data processing for the performance of contracts with you, as well as for carrying out pre-contractual actions upon your request.

Art. 6 para. 1 sentence 1 letter c) GDPR for data processing required to fulfill a legal obligation to which Umtriebig GmbH is subject, e.g., obligations under commercial and tax law.

Art. 6 para. 1 sentence 1 letter f)  GDPR for data processing where we have a legitimate interest. According to this provision, the processing of personal data is lawful if it is necessary to protect the legitimate interests of the controller, i.e., Umtriebig GmbH, or a third party, unless the interests or fundamental rights and freedoms of the data subject, i.e., you, prevail.

Duration of storage / criteria for storage duration

Umtriebig GmbH stores your personal data until the purpose on which the processing is based (see → Purposes of data processing) no longer applies. If Umtriebig is legally obliged to store personal data, the data will be stored for the duration of the legal obligation. For commercial documents, which include trading books and receipts (including invoices), this is 10 years (§ 257 (4) of the German Commercial Code). If necessary, your data will be blocked for ongoing operations during this period, provided there is no other purpose for processing.

 

Rights of the data subject

 

Rights pursuant to Art. 15 – 18, 20 GDPR

You have the right to request information from us at reasonable intervals about your stored personal data (Art. 15 GDPR). This information extends to the question of whether Umtriebig has stored personal data about you and, among other things, what data is involved and for what purposes the data is processed. Upon request, Umtriebig will provide you with a copy of the data that is the subject of the processing.

In addition, you have the right to request Umtriebig to correct incorrectly stored data (Art. 16 GDPR).

You also have the right to request Umtriebig to erase your personal data (Art. 17 GDPR). Among other things, we are obliged to erase your personal data if it is no longer necessary for the purposes for which it was collected or otherwise processed, if you have withdrawn your consent or if the data has been processed unlawfully.

Under certain conditions, you have the right to restrict the processing of your personal data (Art. 18 GDPR). This includes if you dispute the accuracy of your personal data and we have to check your objection. In this case, your data may not be further processed by us, with the exception of storage, until the question of accuracy has been clarified.

If you wish to switch to another agency, you have the right to have the data that you have provided to us on the basis of your consent or on the basis of an existing contractual relationship with you handed over to you in a machine-readable format or – at your discretion – transferred to a third party (right to data portability, Art. 20 GDPR).

 

No contractual or legal obligation to provide the data / Consequences of non-provision

You are not contractually or legally obliged to provide us with your personal data. Please note, however, that you cannot conclude a contract with us for the use of our services if we are not permitted to collect and process the data that we require for the stated purposes (see → Purposes of data processing).

 

Right to object at any time pursuant to Art. 21 GDPR

If the processing of your data by Umtriebig is based on the performance of a task carried out in the public interest or in the exercise of official authority (Art. 6 para. 1 sentence 1 letter e) GDPR) or if data processing is based on legitimate interests of Umtriebig, you have the right to object to the processing of your personal data at any time for reasons arising from your particular situation. Umtriebig will then terminate the processing unless we can demonstrate compelling legitimate grounds for the processing which override your interests in terminating the processing. You can object to the processing of your personal data for direct marketing purposes at any time without restriction.

 

Right to withdraw consent at any time

If the data processing by Umtriebig is based on your consent, you have the right to withdraw your consent at any time. The legality of the processing carried out on the basis of the consent until the revocation remains unaffected by the revocation.
